Information we collect and how we use it

We offer services that do not require you to register for an account or provide any personal information to us. In order to provide our full range of services, we may collect the following types of information:

Information you provide

  • Identity Data and Contact Data - When you sign up for a Kwiziq account or other Kwiziq service or promotion that requires registration, we ask you for personal information such as your title, name, email address and an account password; we store your password in an encrypted form so that even we do not know it. If you make a purchase we may ask for your address. We will use the data you provide to send you a series of on-boarding emails.
  • Financial Data and Transactional Data - If we need to take credit card, financial or payment details from you, we will either use a regulated third party (such as PayPal, Google Checkout, or a service provided by a regulated bank) in which case they may store your financial details, or we will store data in an encrypted form. We will never store financial information you supply to us in a form which is not secure.
  • Profile Data - We may provide the ability for you to create a public profile, including personal details and one or more photos of yourself. Your profile may also be linked to your Facebook account in which case some data may be shared with Facebook. You may need to adjust your Facebook privacy settings. Anything you write about yourself in the details section of your profile is publicly available and may be available for other users to see, therefore you should not post anything you wish to keep private here. Do not write contact details such as your email address on your profile except in the contact details fields which are private and remain unpublished unless you explicitly give permission to certain users to see them.
  • Cookies - When you visit our website, we send one or more cookies to your computer or other device that uniquely identifies your browser. We use cookies to improve the quality of our service, including for storing user preferences. Kwiziq may use cookies to help us improve the relevancy of advertising campaigns you receive.
  • Technical Data and Usage Data - When you access Kwiziq services, our servers automatically record information that your browser sends whenever you visit sections of our website and use or services. These server logs may include information such as your web request, Internet Protocol address, browser type, browser language, the date and time of your request and one or more cookies that may uniquely identify your browser. We may also collect any feedback or survey responses you provide to us.

Other data we may store about you

  • We may collect data about your language knowledge based on your use of our services, tools and games in order to support your language learning and tailor our educational programmes to your specific needs. We retain the right to this data, but we collect it for your benefit. You can see the data we hold about you and your language skills using the various reports available on the site. You may also request to see all the data we hold about you and we will do our best to provide it directly (though we cannot guarantee to supply it in a particular form).
  • User communications - When you send email or other communications to Kwiziq, we may retain those communications in order to process your inquiries, respond to your requests and improve our services.
  • Links - Kwiziq may present links in a format that enables us to keep track of whether these links have been followed. We use this information to improve the quality of our services, customized content and advertising.

We also collect, use and share Aggregated Data such as statistical or demographic data for any purpose. Aggregated Data could be derived from your personal data but is not considered personal data in law as this data will not directly or indirectly reveal your identity. For example, we may aggregate your Usage Data to calculate the percentage of users accessing a specific website feature. However, if we combine or connect Aggregated Data with your personal data so that it can directly or indirectly identify you, we treat the combined data as personal data which will be used in accordance with this privacy policy.

We do not collect any Special Categories of Personal Data (also known as “sensitive data”) about you (this includes details about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about your health, and genetic and biometric data). Nor do we collect any information about criminal convictions and offences.

Where we need to collect personal data by law, or under the terms of a contract we have with you, and you fail to provide that data when requested, we may not be able to perform the contract we have or are trying to enter into with you (for example, to provide you with goods or services). In this case, we may have to cancel a product or service you have with us but we will notify you if this is the case at the time.

  • Where it is necessary for our legitimate interests (or those of a third party) and your interests and fundamental rights do not override those interests.

Promotional offers from us

Choices for personal information

When you sign up for a particular service that requires registration, we may ask you to provide additional personal information. We will only use your personal data for the purposes for which we collected it, unless we reasonably consider that we need to use it for another reason and that reason is compatible with the original purpose. If you wish to get an explanation as to how the processing for the new purpose is compatible with the original purpose, please contact us.

If we wish to use this information in a manner different than the purpose for which it was collected, we will notify you and we will explain the legal basis which allows us to do so.  Please note that we may process your personal data without your knowledge or consent, in compliance with the above rules, where this is required or permitted by law.

If we propose to use personal information for any purposes other than those described in this Privacy Policy and/or in the specific service privacy notices, we will offer you an effective way to opt out of the use of personal information for those other purposes. We will not collect or use sensitive information for purposes other than those described in this Privacy Policy and/or in the supplementary service privacy notices, unless we have obtained your prior consent.

Kwiziq may uses 3rd party advertising cookies such as Google's AdSense.

You can decline to submit personal information to any of our services, in which case Kwiziq may not be able to provide those services to you.

Information sharing

Kwiziq only shares personal information with other companies or individuals outside of Kwiziq in the following limited circumstances:

International transfers

Kwiziq processes personal information on our servers in the United States of America, United Kingdom, the Netherlands, Poland, Spain, and other countries. In some cases, we process personal information on a server outside your own country. We may process personal information to provide our own services. In some cases, we may process personal information on behalf of and according to the instructions of a third party, such as our advertising partners.

Whenever we transfer your personal data out of the EEA, we ensure a similar degree of protection is afforded to it by ensuring at least one of the following safeguards is implemented:

The data we store about your language skills may be made available to 3rd party language services that use our API in order that they can provide services to help you improve your language skills, but they may not store this data about you. For example, a 3rd party may have a game that helps improve vocabulary skills that, using our API, can work out what vocabulary you need to practice next in order to improve and then serve the content most suited to your needs.

We require opt-in consent for the sharing of any sensitive personal data.

We provide such information to our subsidiaries, affiliated companies or other trusted businesses or persons for the purpose of processing personal information on our behalf. We require that these parties agree to process such information based on our instructions and in compliance with this Privacy Policy and any other appropriate confidentiality and security measures.

We have a good faith belief that access, use, preservation or disclosure of such information is reasonably necessary to (a) satisfy any applicable law, regulation, legal process or enforceable governmental request, (b) enforce applicable Terms of Service, including investigation of potential violations thereof, (c) detect, prevent, or otherwise address fraud, security or technical issues, or (d) protect against harm to the rights, property or safety of Kwiziq, its users or the public as required or permitted by law.

If Kwiziq becomes involved in a merger, acquisition, or any form of sale of some or all of its assets, we will ensure the confidentiality of any personal information involved in such transactions and provide notice before personal information is transferred and becomes subject to a different privacy policy.

We may share with third parties certain pieces of aggregated, non-personal information, such as the number of users who searched for a particular term, or how many users reached a certain level of competence in a language. Such information does not identify you individually.

Information security

We take appropriate security measures to protect against unauthorized access to or unauthorized alteration, disclosure or destruction of data. These include internal reviews of our data collection, storage, processing practices and security measures, as well as physical security measures to guard against unauthorized access to systems where we store personal data.

We restrict access to personal information to Kwiziq employees, contractors and agents who need to know that information in order to operate, develop or improve our services. These individuals are bound by confidentiality obligations and may be subject to discipline, including termination and criminal prosecution, if they fail to meet these obligations.

We have put in place procedures to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where we are legally required to do so.

Data integrity

Kwiziq processes personal information only for the purposes for which it was collected and in accordance with this Privacy Policy or any applicable service-specific privacy notice. We review our data collection, storage and processing practices to ensure that we only collect, store and process the personal information needed to provide or improve our services or as otherwise permitted under this Policy. We take reasonable steps to ensure that the personal information we process is accurate, complete, and current, but we depend on our users to update or correct their personal information whenever necessary.

Data retention

We will only retain your personal data for as long as reasonably necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, regulatory, tax, accounting or reporting requirements. We may retain your personal data for a longer period in the event of a complaint or if we reasonably believe there is a prospect of litigation in respect to our relationship with you.

To determine the appropriate retention period for personal data, we consider the amount, nature and sensitivity of the personal data, the potential risk of harm from unauthorised use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal, regulatory, tax, accounting or other requirements.

In some circumstances we will anonymise your personal data (so that it can no longer be associated with you) for research or statistical purposes (such as when we use third-party machine learning tools for rapid development), in which case we may use this information indefinitely without further notice to you.

Accessing, updating or deleting personal information

If you no longer wish us to hold data about you, then you can request that we purge your account and we will destroy any data we hold that could be used to identify you. We reserve the right to keep statistical or anonymised data. We will no longer have any way of knowing to whom the data once referred.

When you use Kwiziq services, we make good faith efforts to provide you with access to your personal information and either to correct this data if it is inaccurate or to delete such data at your request if it is not otherwise required to be retained by law or for legitimate business purposes. We ask individual users to identify themselves and the information requested to be accessed, corrected or removed before processing such requests, and we may decline to process requests that are unreasonably repetitive or systematic, require disproportionate technical effort, jeopardize the privacy of others, or are extremely impractical (for instance, requests concerning information residing on backup tapes), or for which access is not otherwise required. In any case where we provide information access and correction, we perform this service free of charge, except if doing so would require a disproportionate effort. Changes to this Privacy Policy

Please note that this Privacy Policy may change from time to time. We will not reduce your rights under this Privacy Policy without your explicit consent, and we expect most such changes will be minor. Glossary

LAWFUL BASIS

‘Legitimate Interest’ means the interest of our business in conducting and managing our business to enable us to give you the best service/product and the best and most secure experience. We make sure we consider and balance any potential impact on you (both positive and negative) and your rights before we process your personal data for our legitimate interests. We do not use your personal data for activities where our interests are overridden by the impact on you (unless we have your consent or are otherwise required or permitted to by law). You can obtain further information about how we assess our legitimate interests against any potential impact on you in respect of specific activities by contacting us.

‘Performance of Contract’ means processing your data where it is necessary for the performance of a contract to which you are a party or to take steps at your request before entering into such a contract.

‘Comply with a legal obligation’ means processing your personal data where it is necessary for compliance with a legal obligation that we are subject to.

YOUR LEGAL RIGHTS

You have the right to:

Request access to your personal data (commonly known as a "data subject access request"). This enables you to receive a copy of the personal data we hold about you and to check that we are lawfully processing it.

Request correction of the personal data that we hold about you. This enables you to have any incomplete or inaccurate data we hold about you corrected, though we may need to verify the accuracy of the new data you provide to us.

Request erasure of your personal data. This enables you to ask us to delete or remove personal data where there is no good reason for us continuing to process it. You also have the right to ask us to delete or remove your personal data where you have successfully exercised your right to object to processing (see below), where we may have processed your information unlawfully or where we are required to erase your personal data to comply with local law. Note, however, that we may not always be able to comply with your request of erasure for specific legal reasons which will be notified to you, if applicable, at the time of your request.

Object to processing of your personal data where we are relying on a legitimate interest (or those of a third party) and there is something about your particular situation which makes you want to object to processing on this ground as you feel it impacts on your fundamental rights and freedoms. You also have the right to object where we are processing your personal data for direct marketing purposes. In some cases, we may demonstrate that we have compelling legitimate grounds to process your information which override your rights and freedoms.

Request restriction of processing of your personal data. This enables you to ask us to suspend the processing of your personal data in the following scenarios:

Request the transfer of your personal data to you or to a third party. We will provide to you, or a third party you have chosen, your personal data in a structured, commonly used, machine-readable format. Note that this right only applies to automated information which you initially provided consent for us to use or where we used the information to perform a contract with you.

Withdraw consent at any time where we are relying on consent to process your personal data. However, this will not affect the lawfulness of any processing carried out before you withdraw your consent. If you withdraw your consent, we may not be able to provide certain products or services to you. We will advise you if this is the case at the time you withdraw your consent.

You will not have to pay a fee to access your personal data (or to exercise any of the other rights). However, we may charge a reasonable fee if your request is clearly unfounded, repetitive or excessive. Alternatively, we could refuse to comply with your request in these circumstances.

We may need to request specific information from you to help us confirm your identity and ensure your right to access your personal data (or to exercise any of your other rights). This is a security measure to ensure that personal data is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request to speed up our response.

We try to respond to all legitimate requests within one month. Occasionally it could take us longer than a month if your request is particularly complex or you have made a number of requests. In this case, we will notify you and keep you updated.
